Examining the Concept of Due Process

Filed under: Legal News — kanedynamics @ 9:28 pm

When a citizen of the U.S. is arrested for a particular criminal act, he is entitled to a speedy trial by his peers. The US Constitution is actually quite clear about this particular right. Broadly speaking, Due Process will involve a 12-person jury. These jury members will have been summoned to appear before the court and are then carefully chosen by the criminal defense lawyers as well as the prosecutor’s office. This is known as Jury Duty and is the duty of every citizen in the Denver community as well as every citizen in each state that is of a certain legal adult age. The criminal defense attorney in question may screen out every prospective juror if he feels the juror may be biased against his client or not sympathetic to his case. The Judge on the case may also eliminate prospective jurors as well as the prosecuting attorney. Their decision to eliminate or disqualify a prospective juror may be for many different reasons. The prosecutor will do his or her level best to choose jurors sympathetic to the victim. However, no prospective juror is to be eliminated based on race, gender or religios persuasion. Generally speaking, the prosecuting attorney must prove the guilt of the defendant beyond reasonable doubt. The criminal defense attorney will work hard to cast some doubt regarding the evidence brought against his client. Those who are experienced in criminal defense law should only handle these particular kinds of cases. When you have been charged with a crime the veteram, seasones criminal defense attorney may very well be your saving grace. The criminal defense attorney will have knowledge of all the specific laws that can be used in your defense. Only your Denver criminal defense attorney

Celebrity and Seattle Criminal News

Filed under: Legal News — kanedynamics @ 6:53 pm

There are reports that the rap singer and Sean Combs also known as P. Ditty is in the process of opening a car service for those on the A list this he feels will help them to party responsibly and his main reason is to lower celebrity DUI arrests. There have been several recent DUI arrests in the Hollywood crowd and this service will bring those to an end.

In a report in Us Weekly a representative for Combs said he plans to make the streets of California safer by opening a car service to transport celebrities after they have consumed alcohol. It was also said that he wants to see that no one is arrested and that there is a lack of taxicabs in Los Angeles.

Combs has partnered with Ciroc Vodka and to date there is no mention of what his new car service will be named or when it will begin to transport the Hollywood elite.

This is just one of the well known rap singers ventures and it is planned to make the streets safer and cut down on the number of celebrity arrests, this will also make the lives of the Paparazzi far more boring.

All of this comes at a point in time when many celebrities have been receiving either drunk driving or reckless driving arrests. One of the latest was Scott Weiland, lead singer of the rock bands the ‘Stone Temple Pilots’ and more recently, the all-star band ‘The Velvet Revolvers’. He was pulled over on  a

Los Angeles highway recently and refused to submit to a sobriety test.  Other celebrities which have been involved in either dui or reckless driving in recent memory include actor Kiefer Sutherland, boxer Mike Tyson, model and heiress Paris Hilton, singer Britney Spears and actress Hillary Duff. Not only are there a lot of dui cases among celebrities but there are also many among other high profile people throughout the country as well. For instance, For instance,

Seattle city Councilwoman Jane Hague recently recieved six months of probation not to mention seventy-five odd hours of community service, according to her lawyer. Speaking of Seattle, if you should ever require a top flank

Goji Juice and other Antioxidant rich Super foods

Filed under: Health News — kanedynamics @ 6:09 am

Here is a wonderful article about the acai berry and also Himalayan Goji Juice and their specific healthful qualities. I hope that you find it useful and informative….

So it is now official: the Acai fruit is an energy fruit.  A specific celebrity show host has stated that.  Do not worry if you have not heard of this little fruit before, as the majority of individuals are still finding out about it.  But it will be very famous soon enouph.  This fruit is actually a berry that comes from an Amazonian palm tree that is harvested in the Brazilian rainforest.

The acai fruit is a drupe that measures about an inch in diameter and looks sort of like a grape but does not have as much pulp.  It grows in panicles of seven hundred to nine hundred and two crops of these fruits are produced each year.  The fruit has a seed that is less than ten millimeters in diameter.  The fruit is harvested as a food and is considered to be one of the most important species of three different Caboclo tribes in

Brazil.  The juices from the fruit are often blended into sodas, smoothies and other drinks and are traditionally served in a gourd alongside tapioca and sugar.  In

Brazil it is popularly served in a bowl where it is mixed with granola.  This concoction is often thought of as an energy meal.  The fruit has also been made into ice cream.  More data can be found at Rio Vida Transfer Factor with Acai

It is a very nutritious fruit.  One hundred grams of this powder has nearly five hundred and forty calories, fifty two grams of carbohydrates, eight grams of protein and thirty two grams of fat.  It has forty four grams of fiber, which makes it incredibly valuable as a macronutrient.  It is also rich in fatty acids like oleic acid, palmitic acid and linoleic acid.  It is thought to reduce blood cholesterol.  It contains nineteen amino acids and is very high in aspartic acid and glutamic acid content.  Now another very antioxidant and energy rich food is goji juice which is made from the humble Himalayan worlf berry or goji berry if you will…with this fruit juice however it is especially vital to sort and flush out the best and most nutrient dense goji berries with the highest absorption rates in people.  With the right technology you may be quite certain that the Goji Juice in question is consistent every single time. Go to Goji Juice for data concerning the excellent goji juice formulated by Dr. Earl mendell and the Freelife Corporation.

The most important part of this fruit, though, is its anti-oxidant content.  Anti-oxidants can slow down the aging process by keeping our cells healthy.  Many authorities find that acai fruit is one of the most powerful anti-aging foods in existence.  This small fruit contains more antioxidants than grapes and blueberries.

This truly wonderful fruit may also assist people’s digestion (thanks to its high fiber content), keep their cardiovascular system healthy, and helps with muscle regeneration and contraction. And now back to the star of the show this year:

Acai-rich foods are very difficult to find, as the fruit is rare.  You probably will not find anything with acai as an ingredient in your local grocery store, but you might be able to find it in a health food store or a gourmet store.  Because the fruit is becoming more popular, largely thanks to a popular magazine, it will slowly start becoming easier to find and people might find ways to grow the “super fruit” somewhere outside of

Brazil.

The acai fruit is probably one of the healthiest fruits on the planet.  It may help your muscles, your heart, your digestion, your energy levels and even can prevent early aging and slow down the rest of the aging process.

California and the EPA:the Latest Legal news

Filed under: Technology News, General Headlines, Legal News — kanedynamics @ 8:20 pm

California and the EPA have been disagreeing on the standards of the strictness of their rules.

California, who has been wanting to impose a stricter set of rules for greenhouse gas emission standards for automobiles has been denied.

According to statements from Stephen L. Johnson who is the administrator of the EPA the reason that

California along with fifteen other states is due to White House policy. This policy is to keep a national standard rather than one set by each state, this occurred in December of 2007 and there was also a bill put into law named the Energy Independence and Security Act of 2007 which will require auto makers to product fuel efficient autos including SUV’s and small trucks. This may not be enough for the State of

California since these automakers will have until the year 2020 to produce these fuel-efficient autos that will be a required 35 per gallon. Incidentially, while we are on the subject of California and legal news, if you are in the greater Los Angeles area and you require a good Los Angeles cruise ship accident lawyer  then The law offices of Steven Sweat may assist you in this regard should you need a san diego criminal defense attorney, a Los Angeles cruise ship accident lawyer or perhaps a los angeles drunk driving lawyer. Now back to the news article at hand…….

In answer to this refusal to regulate their own standards the California Attorney General Edmund G. Brown jr.  brought a lawsuit against the United States Environmental Protection Agency for not allowing the state of

California to make their own regulations. This suit was filed January 8th of 2008 in the United States Court of Appeals at the 9th Circuit. Meanwhile, according to the respected online publication ‘The Juror’, it was reported that several days ago EPA officials claimed executive privilege in denying congressional requests for some documents which relate to the agency’s deny the

Golden

State  a waiver from new auto-emissions standards. This particular waiver would have allowed

California as well as some sixteen additional states to follow their example and order substantially toupher greenhouse emissions standards on vehicles

including trucks than those provided for by the EPA.

CA Governor Vetoes three Justice Bills

Filed under: General Headlines, Legal News — kanedynamics @ 5:07 am

According to a Fox news report by the respected journalist Radley Balko,
3 distinct legal recommendations in the golden State have recently been vetoed.
The 1st such legal recommendation to be vetoed would have insured that prosecutors who use prison informants would have to supplement their testimony with other evidence.
This recommendation was put forth since the informants are indeed felons who simply cannot be considered to have trustworthy testimony in a court of law.
They also have plenty of motive to give false testimony iof asked to since they desire to get out of the prison that they are in and are often quite willing to stop at nothing to achieve that goal.
In fact a recent study appears to confirm that a relatively large percentage of convictions which later turned out to be wrong
involved such a prison informer, according to the FOX report. This does seem to make some amount of common since the way the law is currently structered in California with the 3-strikes laws,
The only chance for someone facing a mandatory minimum sentence to get out early is to have information which assists prosecutors to get more convictions. This particular system seems to more or less encourage
dishonesty testimony from such informants. If you are in southern California visit Los Angeles Personal Injury Attorney if you are in need of a good lawyer.
The 2nd reform in question would have mandated that the police department videotape their interrogations in violent crime investigations.
Radley argues that this is a rather sensible and mild reform. But police advocates have staunchly opposed taping interrogations in the past by arguing that they sometimes use untoward or coercive tactics which while in fact completely legal, may
seem somewhat touph to certain jurors.
The commission’s other recommendation was basically designed to solve the issue of false eyewitness testimony, which studies have shown is a major problem. This particular recommendation, Radley argues, should have been less controversial than the other ones.

Over 500,000 products Recalled from China due to Lead Hazard

Filed under: General Headlines — kanedynamics @ 7:54 am

According to an article in Yahoo News and other outlets, Over 500,000 products made in China were recalled today, including “Pirates of the Caribbean” and Baby Einstein toys, since they contain hazardous amounts of lead in them.
Lead is toxic to humans and particularly to children.
At the time of this writing, children’s products found to have more than .06 percent of lead accessible to users are subject to such recall.
Could there be some lawsuits on the horizon here? And who exactly would get the lawsuit here, the manufacturer or the seller of the product?
CPSC spokeswoman Julie Vallese said the effects of lead are cumulative.
“A lot of what is being recalled is because it violates the law, not that there is an imminent health risk,” she said.
This sweeping recall also included cups which are shaped like Frankenstein’s head with high levels of lead on their surface paint. Other products not necessarily for kids were likewise on the recall list including bookmarks and journals with lead-tainted surface paint.
These particular items have various decorations such as breast cancer awareness & Winnie the Pooh, among others. These items were retailed at certain book, card and gift outlets around the nation in the last several years.
“There will be more recalls because of lead violations, but we also anticipate that we will begin to see fewer and fewer of them as a big portion of the marketplace will have been tested,” Vallese said. “What you’re seeing now is the result of a systematic approach to going through inventories.”
China recently executed it’s Food and Drug minister after the last round of pet food and other product recalls. Apparently,
it was not enouph in an economy addicted to the huge trade deficit it enjoys with the US.

‘Die Hard’ Director/Producer Sentenced to 4 Months

Filed under: General Headlines — kanedynamics @ 6:31 am

John McTiernan, the creative force of such big action/adventure Movies as “Die Hard” with Bruce Willis and “Predator” starring the ‘Governator’, was sentenced to 4 months in jail today because he allegedly lied to federal agents.

All in all, he was 1 of 7 defendants who pleaded guilty to being involved in the conspiracy & racketeering case of fallen celebrity detective Tony Pellicano, who was himself charged with illegal wiretaps and illicit database searches to eavesdrop on many Hollywood stars and industry executives.
Wow, even John McClain would have lowered the boom on him for that one.
In any case, the Reuters report states that he previously pleaded guilty to making false statements to Federal agents investigating Pellicano when he stated that he never asked him to wiretap producer Charles Roven, with whom the director worked on the 2002 action film “Rollerball”,
which was a remake of the 70’s action movie that starred James Caan.
United States District Judge Dale Fischer rejected a motion by McTiernan to withdraw his guilty plea. In addition to his 4-month jail term, he got 2 years of supervised release and a one hundred thousand dollar fine as well.
Pellicano, who had previously worked for movie industry big shots like ‘Mission Impossible’ star Tom Cruise & ‘Be Cool’ star John Travolta, faces as many as twenty years in jail for every individual racketeering charge in his 110-count indictment when he goes to court.

Simpson’s Attorney quickly becoming a famous name

Filed under: Uncategorized — kanedynamics @ 3:10 am

According to a Yahoo news report,
O.J.’s attorney Yale Galanter has yet to review the facts surrounding the recent armed robbery charges against him, he maintains that he is in fact innocent. “My gut feeling is that you’ve got two basic accusers,” he states.
”One of them is in the hospital and one is in jail. Obviously, I do not think Simpson is guilty of any of these charges. I do think O.J. gets treated differently because he’s O.J.”
At the beginning of the road rage trial against him in 2001, Simpson evidentally had so much faith in Galanter that he entered the Dade County courtroom singing, “If I Only Had a Brain.” That faith turned out to be well-founded:  he had faced up to sixteen some odd years in prison. Yet Galanter presented
a facinating and smart defense. It seems that the Florida authorities had his thumbprint on the pair of glasses worn by the man that Simpson allegedly cut off while driving his Sport Utility Vehicle in a Dade County neihborhood. But
since the print was actually on the outside of the lens in question, he simply argued that Simpson had not actually snatched the glasses off the man’s face, but instead touched the lens when he put his hands up to keep the other man from coming after him.
While that seems rather unlikely to me, this reasoning might very well have assisted Simpson in avoiding a potential prison sentence.
In addition, it propeled him to a major figure very quickly. Whenever he gets himself into problems with the law - which is quite often - Galanter is there. That included a DEA raid on Simpson’s house in the same year, a ticket for speeding in a manatee zone the year after that, a domestic violence call to his house
the year after that, and his 2006 involvement in the penning of a made up account of the murders of his former wife Nicole and her friend which some people claimed was really confessional. Additional news of this nature can be obtained on The Entertainment News Weblog
Man, this guy is an attorney’s dream, he keeps them working non-stop.
In his early days, Galanter cut his teeth at the Dade State Attorney’s Office under one Janet Reno. Furthermore that is the place that he met his better half, Elyse. She was a court reporter and that is
where Galanter had been assigned as well. They have been together some twenty-one odd years, married for 8 of them.

Heavy Outsourcing Complicates the Food Recalls

Filed under: General Headlines — kanedynamics @ 9:22 pm

While most people are aware of the high profile headlines concerning the recent pet food and human food recalls,
few people realize the difficulty in tracking the sources, according to a recent AP report by esteemed journalist Andrew Bridges.
This is because if you take a look at the ninety-odd brands composing the recall of canned chili, stew & similiar food items, it all points back back to one manufacturer.
This was likewise the situation regarding the recalls of spinach, frozen meat and of course the now sad and infamous pet food recalls,
in which so many innocent animals were killed or severely sickened.
More than ever before, firms are outsourcing the food Americans consume, or at least the ingredients found in them — and then selling these items under many different brand names.
Many of these tainted ingredients come from China. To add insult to injury, many toys from that country have been found with toxic levels of lead in them.
The real issue here is that if individuals can’t trace a particular item back to it’s supplier, then that supplier has very little, if any, reason to keep their facilities or processing plants up to decent standards.
Oversight is remarkly slack. For example, the major brand in the pet food recalls was a co-regulator of the pet food industry along with the FDA.
Apparently, it all comes down to effeciency and simple economics: Outsourcing makes monetary sense for the firms who are unwilling to expand their existing manufacturing facilities. Established manufacturers may use excess capacity to fill the orders for others.
For some certain products which require expensive machinery — such as pet food for example — a limited number of contract manufacturers, like Menu Foods inc, make products which are then sold under many different brand names,
according to the AP report. The skeptics of this outsourcing believe that, in general, it creates increased vulnerability to our food supply. In essence, the manufacturer is no longer responsible to the consumer, but instead to other firms.
Meanwhile, various food safety advocates have repeatedly stated that when issues crop up with food items made under contract, sorting out who made what may delay recalls and public health warnings in general.
As an example, in July the FDA for a number of hours delayed issuing a consumer warning about botulism contamination in various canned food items until it could sort out the brands under which the Castleberry’s Food Co. product was sold.
In addition to this, there has been a fairly long delay in mandating that imported fruits & vegetables be labeled with their country of origin.
